  11. Andrew: Why do you blame Justice Scalia for gutting the right to habeas corpus when he almost always wrote the dissenting opinion and Congress passed the AEDPA in the first place? I’ll caution that I’ve been traveling so they might be based partially on ignorance of some facts but hey: (1) regarding the Golden State Killer and DNA databases, this doesn’t pass my smell test. It sounds like a backdoor way to get personal information. Is this the third party doctrine at work? It doesn’t seem so because my understanding is that his family members consented to the DNA test, not the killer himself. Did they even try to get a warrant? Is there anything in precedent that would say a person has a subjective expectation of privacy that should be objectively acknowledged? (2) Takings! Let’s take super rich Khosla’s attempt to prevent public access to his beach (“his” beach? Admittedly I don’t know this fact) to task, please.
  14. Your legal practice is civil, not criminal. As a Maryland/D.C. attorney, do you find substantive differences in state law? For bonus points, can you tell whether state laws vary widely, or are their differences more regional in nature?
