1. My moms HOA won a lawsuit against her subdivision’s developer’s insurance company at the Texas Supreme Court. The insurance company got a new lawyer right after the judgment and just needed to agree to an appropriate amount in damages which they had done through email per my mom. She wants to know the appropriate amount of time to let the new attorney get familiar with the case. It’s been 7 months. The lawsuit started around 12 years ago.
  2. My county legislature just passed a law criminalizing conduct "intend[ing] to annoy, alarm, or threaten" police officers or first responders. My gut instinct is that "annoy" is not a verb you can prosecute, but I don't know why. Please confirm or deny.
  3. Will you share the guitar tablature for the Opening Arguments theme song?
  4. Andrew: what is your biggest regret as regards choosing to be a lawyer for a career. Thomas,: what is your biggest regret as regards being a Sharks fan
  5. Listener Thomas S asks if Andrew needed a good lawyer would be go for the big named lawyer or someone he knew that was a good lawyer and what is the difference in compensation between the 2.
  6. Thomas taking the essay part of the bar exam wouldn't make for good podcast material, but can you give us a quick overview on the sort of things you might be asked to write on?
  7. I am a religious person with a conservative centrist political position. One thing that baffles me is the legal arguments against gay marriage? I am of the opinion that if two people wish to be together and legally married who am I to stop them. I understand (although don't necessarily adhere) to the social argument against gay marriage but I would love it if you do an episode on the potential legal implications of gay marriage. I love the episodes were you 'Steel Man' an argument and then dissect them according to your own more liberal views. You guys do great and interesting work. Also SEATTLE Live Show!
  8. Did you see John Oliver's musical send up of coal mine owner & asshat Bob Murray in which a troupe of entertainers accuse him of various horrible traits and actions? At one point, Oliver says, "That's right, if we discuss Bob Murray in a way no reasonable person could construe as factual, we can say whatever the fuck we like!" Is that a correct restatement of the legal principle? Given the fucknuttery seen on certain corners of public discourse, who decides what a "reasonable" person is? (i.e., is the guy who took a gun to Comet Ping Pong reasonable?)
  9. Why isn't Guiliani working pro bono an excessive in kind campaign donation?
  10. Andrew, have you ever ended up in court because of something Eli Bosnick said or did?
  11. What can be done about bad faith testimonies, such as Corey Lewandowski's? Purgery? Contempt? Should we even expect any kind of justice for someone clearly trying to obstruct the process?
  12. At some point I remember Andrew stating that California can't just take over PG&E. Could California use eminent domain to take over all of PG&E's infrastructure instead? Clearly eminent domain law should work out such that PG&E would *pay* California to do this, since it's obvious at this point that their infrastructure has a net negative value.
  13. How would Obergefell get overturned. Who would have standing to bring a case to overturn it. Would a state have to pass a gay marriage ban and lose at every step until it got back to the Supreme Court. If that is the case why hasn't Mississippi or Alabama done this yet?
  14. With regard to Trump breezing through the impeachment and going on to win 2020, there's an angle I haven't seen on the show before: his rapidly deteriorating health. He slurs his words, loses vocabulary, and has an atrocious gait, recently more than ever. I haven't seen many of his recent speeches (they're so vapid, why would anyone bother anyway), so it utterly shocked me when I did see. I don't think he's got a year left of public viability, guys. What do you think?
  15. Why are Republican Senators allowed to meet with Trump to devise an impeachment trial plan? Isn't that like a defense attorney meeting in private with jurors?
