1. What is your favorite candy?
  2. On the last episode, you recommended for Democratic senators to read the Pence call transcript into the record. Do senators still even *have* access to it? They presumably weren't able to take any notes out of the SCIF?
  3. Do you think the Dems should fight (mildly) dirtier? Nicknames (Moscow Mitch etc.), memes, trolling - by all accounts it just seems to work. A big part of 45’s appeal is just that people re entertained. Any thoughts?
  4. Would it be possible (at least in theory) for Dems to remove Gorsuch and Kavanaugh after a hypothetical 2020 takeover of the executive and legislative branches? If so, how would they go about doing this and how likely would it be?
  5. If the White House doesn’t actually have a defense for killing Soleimani, is that murder? If they can’t show there was an imminent threat, can’t draw a line to the AUMF, and there is evidence to suggest Trump wanted him dead months in advance, how is this not murder? I looked up the military code, and murder is Article 118 and it defines murder as the killing of another human being without justification or excuse. If Trump has no justification or excuse for ordering the air strike, is there an executive privilege that lets him just blow up anyone he wants with the military? And if the commander in chief gives an unlawful order, does that fall under civilian law because he’s a civilian or under military law because it was a military order? Or is it really just a case of he’s the president so he can do whatever the clownhorn he wants?
  6. Any thoughts on what you'd do to try and fix Fox News and their outright disinformation and propaganda while balancing first amendment concerns?
  7. If someone's cognitive abilities are so poor they need a guardian (e.g. someone with intellectual disability), can they waive their Miranda rights? If someone is unable to control their speech due to neurological disability (e.g., can't choose to withhold information, can't understand concepts like lying or secrets, can't prevent self from speaking - some people with autism, certain types of brain damage), can they waive their Miranda rights?
  8. If there is no harm done when someone changes a date for a signature (re: your segment on why we don't need to write the full "2020"), then why do we write the date at all?
  9. How old do you think is too old for someone to go to law school? How would you envision the career path for a second (or third) career lawyer? Is there de facto ageism in law school admissions?
  10. Andrew's lung collapsing story
  11. If a person is openly a Nazi, and therefore (by implication) advocating the murder of minorities, could a member of a minority punch them and claim self-defense? To put it more precisely, why is advocating genocide not an explicit threat to a person's life?
  12. Is there any update in the Mazars case? Do we know anything about when the supreme court will hear the case and do you have any predictions regarding the outcome?
  13. If the Co-Host of a Podcast were to run for a Political Office, would there be any Election Laws that might affect that Candidate's ability to continue to produce a podcast?
  14. What is the legal reason that people need to declare their party affiliation when registering to vote?
